Wyoming's two rules for nursing care facilities — Chapter 11, Program Administration of Nursing Care Facilities (effective 07/01/2020), and Chapter 19, Licensure of Nursing Care Facilities — and the Health Facilities Act, W.S. 35-2-901 through 35-2-914, enumerate no permissible bases for a facility-initiated transfer or discharge and state no notice period or resident appeal for one. Chapter 11 uses discharge only for discharge planning and the release of drugs, and transfer for hospital transfer agreements. What Wyoming publishes is a notice on the department's side: under Medicaid Chapter 22, when the department's nursing facility level of care determination goes against a resident, the department "shall provide notice of adverse action and the right to request an administrative hearing to any individual whose Medicaid service coverage or eligibility is denied, reduced, terminated, or suspended as a result of its reconsideration determination." (Section 6(e)). Chapter 11 requires each facility to keep posted, for residents, "telephone numbers and addresses of" "the Long-Term Care Ombudsman, Protection and Advocacy, the local Department of Family Services Adult Protection office, the Medicaid Fraud Control Unit, the Wyoming State Survey Agency, and the facility’s grievance/complaint representative." (Section 19(a)(iii)).

Hearing office in these sources

No office hears a resident's appeal of a facility's own transfer or discharge decision in the sources reviewed; Chapter 11's hearing section is for facilities — "Any Nursing Care Facility aggrieved by a decision of the Program Division may request a hearing by submitting a written request to the Program Division within ten (10) days of the date of the adverse action at 6101 Yellowstone Road, North Building, Room 259B, Cheyenne, WY 82002." (Section 22(b)). The resident-side route Wyoming publishes runs through Medicaid: a level-of-care determination may be contested under Chapter 22, Section 6, and heard under Medicaid Chapter 4, where "A client’s request for a hearing shall be submitted electronically via email to the" "Department, made verbally to the Department, mailed to the Department via certified mail, return receipt requested, or personally delivered to the Department within twenty (20) business days after the mailing of the notice of adverse action." (Section 7(a)). Chapter 4 names no email address, street address or form for that request. Wyoming Medicaid's Institutional Provider Manual states, of a resident review that finds a resident inappropriate for nursing facility placement, that "Adverse determinations carry the right of appeal for the resident."

This page assembles what Wyoming's own publishers state about involuntary transfer and discharge from a nursing care facility. It is a baseline page: the docket rows and the source map are built; the grounds section and the published-process section are not yet written, as the change log records. The fullest single source is Chapter 11, Program Administration of Nursing Care Facilities, the Department of Health's rule effective 07/01/2020, and what it states is mostly what it does not: it enumerates no grounds, sets no notice period and gives no resident an appeal of a facility's decision to move them. Wyoming's own vocabulary, where it speaks at all, is discharge and transfer in the ordinary clinical sense, and adverse action for the Medicaid determinations a resident can contest.
