These terms cover your use of roomandrecourse.com, published by Field Assembly LLC, a Massachusetts limited liability company. There is no account to create, nothing to buy, and no subscription. You are reading a free publication, so these terms are correspondingly short, and the section that matters most is the second one.

What this site is
Room & Recourse assembles each state's own published statements about involuntary nursing-home transfer and discharge, with the federal materials — 42 CFR 483.15, the fair-hearing rules at 42 CFR part 431, and CMS's own guidance — on a page of their own. Every page quotes those documents with two dates — the date the source itself carries and the date it was retrieved — links to the originals, records a review date and a named reviewer, and states absences as findings rather than passing over them.
The pages are free in full and stay that way. They are independent of every facility and operator, of CMS and every state agency, and of the ombudsman programs named anywhere on this site.
What these pages are not
Read this section even if you skip the rest.
The agency's own document governs, always. These pages quote what an agency published on a stated date. Agencies revise their rules, notices, addresses, and contacts, sometimes without notice and sometimes without changing the document's own date. A quotation that was exact when it was recorded can be stale by the time you read it. Every page links to the original for this reason. Where a page here and the agency's current document disagree, the agency's document is what applies.
This is not legal or medical advice, and we are not your lawyer, advocate, or representative. Reading these pages creates no professional relationship of any kind. A transfer or discharge notice carries real dates, and a late step can cost a hearing, a bed, or a home. Every period and every date on these pages is quoted from a source, not calculated for any particular case. The pages never determine whether a notice is lawful, never determine whether grounds apply to a situation, never evaluate a facility's stated reason, never restate deadlines as advice about when to act, and never predict outcomes. Those determinations belong to the hearing offices.
Where something important turns on it, verify it at the source. The linked original is the authority, the office named on it answers questions about it, and where a hearing, a bed, or the roof itself is at stake, an elder-law attorney, the long-term-care ombudsman, or the hearing office is the place to take the question. These pages exist to make the agencies' own statements findable, so that better questions can be asked. They do not exist to answer them.
Accuracy is taken seriously here and every page is re-verified on a stated cadence. Even so, no page is warranted to be complete, current, or correct, and it cannot be, because the documents underneath it are not ours.
Corrections
Corrections are made on the record. When something here is wrong, the page is fixed and the change log says what changed and when, rather than the page being edited silently.
If you find an error, write to hello@fieldassembly.net. A link to the official document you are reading it against is the most useful thing to send. Please leave out the resident's name, the facility, and the details of your own situation; none of it is needed to fix a page, and the privacy page explains why.
Using these pages
Read them, quote them, link to them, print them, and hand them to a family that needs them. Attribution is appreciated and a link is better than a citation, because it lets the next person check the sources for themselves.
Do not present these pages as your own, and do not republish them in a form that strips the source links, the dates, or the reviewer notes, because those are the parts that make them worth trusting.
Do not use automated means to overload the site. There is no other acceptable-use rule worth writing, because there is nothing here to abuse: no accounts, no uploads, no user content, and no way to reach anyone but us.

They belong to the agencies that published them, and are quoted, with attribution and a link, for the purpose of reporting and commenting on what those bodies have said — the ordinary business of a reference work. Works published by the federal government are not subject to copyright; works published by state governments generally are not, though this varies by state.
Copyright questions and infringement notices are handled through Field Assembly's DMCA and copyright process.

These terms may be revised. The effective date at the top records when, and a material change will be described rather than slipped in.
